North Carolina - Mortgage Fraud Resources

Effective Oct. 1, 2008, the state of North Carolina began limiting the payment of a yield spread premium on rate spread home loans. A few months later the state's Mortgage Lending Act was signed into law, requiring the licensing of mortgage loan servicers.

These laws are helping state officials keep better track of mortgage lenders and their activities throughout North Carolina. However such legislation is just one step - consumers need to be aware of the mortgage fraud trends that could impact them. A list of resources below can help consumers address and investigate possible fraud.

FBI field offices are responsible for investigating potential cases of fraud and work with the offices of the state and federal attorneys general to prosecute criminals. Local offices of the Department of Housing and Urban Development (HUD) can help mortgage applicants find the resources they need to make smart mortgage decisions.

The North Carolina Office of the Commissioner of Banks helps to set rules, investigate complaints and exercise enforcement/disciplinary authority over the businesses it oversees. The state Real Estate Commission and Appraiser Board each have numerous sources of mortgage fraud information for consumers and can direct them to appropriate contacts for specific questions on mortgage fraud.

Finally, the Better Business Bureau sets guidelines by which businesses should operate and takes steps to ensure that consumers are treated fairly.
